Welcome to Elevated Outreach! These Terms of Service (“Terms”) govern your access to and use of our services (“Services”) provided by Elevated Outreach (“we,” “us,” “our”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By checking the box, clicking the button next to a link to these Terms on any of our sign-up pages, executing an order form or statement of work referencing these Terms, signing up for an account, logging in to your account, or accessing any part of the Services, you (“Client,” “you,” “your”) represent and warrant that (1) you have read, understand, and agree to be bound by these Terms, (2) you are at least eighteen (18) years of age, (3) the information you provided during registration is true, accurate, current, and complete, and (4) you have the authority to enter into this agreement personally or on behalf of an organization that you represent as an authorized user.

2. Scope of Services

Elevated Outreach provides specialized outreach services designed to increase your business revenue and generate leads. The specific Services will be outlined in a separate service agreement. We reserve the right to modify our Services at any time.

3. Service Modifications

We may change any terms of this Agreement by posting a revised Agreement on our website. The revised Agreement will be effective immediately upon posting or on the effective date indicated in the new Agreement. If you do not agree with the terms, you must immediately discontinue your use of the Services. Continued use of the Services constitutes acceptance of the revised terms. We recommend regularly checking our website for the current terms.

4. Eligibility and Client Responsibilities

• Eligibility: Clients must be at least 18 years old and possess the authority to enter into legally binding agreements.

• Responsibilities: You agree to provide accurate and complete information during registration and throughout the duration of our Services. Any failure to provide accurate information may result in the suspension or termination of your account.

5. Confidentiality

Elevated Outreach is committed to maintaining the confidentiality of your information. All data and strategies shared between you and Elevated Outreach will remain confidential and will not be disclosed to third parties without your consent, except as required by law.

6. Payment Terms

• Fees: Payments for our Services will be due as specified in the service agreement. Invoices will typically be issued monthly, and payments are due within fourteen (14) days of receipt.

• Late Payments: Failure to pay may result in the suspension of Services until full payment is received. We reserve the right to charge late fees as outlined in the service agreement.

7. Termination of Services

• Client Termination: You may terminate Services by providing written notice at least thirty (30) days before the intended termination date.

• Elevated Outreach Termination: We reserve the right to terminate Services for non-compliance with these Terms or for non-payment. In such cases, any outstanding payments remain due.

8. Intellectual Property Rights

• Ownership: All intellectual property developed by Elevated Outreach during the provision of Services remains our property unless otherwise specified in a service agreement.

• License: Upon payment, you are granted a non-exclusive, non-transferable license to use deliverables provided as part of the Services for your internal business purposes.

9. Limitation of Liability

Elevated Outreach is not liable for indirect, incidental, or consequential damages, including but not limited to loss of revenue, data, or reputation. Our liability for any claim shall be limited to the amount paid by you for Services rendered in the preceding three (3) months.

10. Indemnification

You agree to indemnify and hold harmless Elevated Outreach, its affiliates, officers, agents, and employees from any claims, damages, liabilities, and expenses, including reasonable attorney fees, arising out of or in connection with your use of our Services or breach of these Terms.

11. Governing Law and Dispute Resolution

• Jurisdiction: These Terms shall be governed by the laws of the State of Washington.

• Dispute Resolution: Any disputes arising from or related to these Terms shall be resolved through binding arbitration in Seattle, Washington, in accordance with the rules of the American Arbitration Association.

12. Entire Agreement

These Terms, along with any other documents incorporated by reference, constitute the entire agreement between you and Elevated Outreach. Any prior agreements or understandings, whether written or oral, are superseded by these Terms.
